If you have been stopped and charged by either the Ontario Provincial Police (OPP) or local municipal police, it is important to understand the repercussions of a conviction as well as the potential costs and benefits of contesting your charge(s) at court. A conviction will generally result in a fine ranging anywhere from a minor fine below a hundred dollars, up to a very large fine ranging in the thousands of dollars. We understand that being charged by the police can be a stressful experience, especially in cases where a collision or injuries may be involved. We also understand how that stress can then be compounded by the thought of having to attend court or having to prepare and file legal documents with court staff. For the majority of the cases that we represent defendants on, it is common that a resolution can be reached with the Prosecutor’s Office without the need for full trial. By filing for and reviewing the evidence to be used against you at trial, we can meet with the Prosecutor in advance of trial to determine the legal merits of their case.
Ideally, the best case resolution is to find a legally sufficient argument to have the charge(s) withdrawn outright at an early resolution meeting. If the charge(s) cannot be withdrawn, then we can negotiate on your behalf to determine if an acceptable plea deal can be reached to reduce the number of charges, the nature of the charges, or the penalties associated with the charges. We can then review with you the merits of the plea deal in regards to the possible benefits and risks of trial for you to make an educated decision on how you wish to proceed. Should your interests be best served by proceeding to trial, you will have the benefit of a licensed paralegal arguing in the courtroom on your behalf and may never have to speak before the court yourself.
