Our friendly administrative and court staff can assist you if you have been stopped and charged by the police. Whether you have been charged under the Highway Traffic Act or the Compulsory Automobile Insurance Act, by municipal police or the Ontario Provincial Police, it is important that you avoid a hasty decision that could carry long-term consequences. Fines for an offence in Ontario could range from a small fine under a hundred dollars, up to a fine in the tens of thousands of dollars. Some offences can also result in a court ordered suspension of your driver’s license, or a suspension from the MTO due to demerit points or other grounds such as an escalated sanctions suspension for novice drivers such as those with a G1 or G2 license. Some of the most serious offences can also result in imprisonment.

For most simple matters, our team can gather the necessary information from you and provide you with the basic information you will need within as little as 10 to 15 minutes. Some defendants simply plead guilty to an offence without realizing that they have an arguable defence, or without realizing that the offence can likely be negotiated to a lesser offence or reduced penalties. Our team can provide you with the candid information you need to protect your interests and avoid costly penalties that can interrupt your ability to meet your daily personal, family, and work obligations.

At Leamington OTD Legal Services, our team helps people such as yourself with minor offences such as speeding, driver fail to properly wear seatbelt, change lane not in safety, fail to drive in marked lane, amber or red light fail to stop, and fail to surrender license. We also help defendants who have been issued charges related to a motor vehicle collision or commercial motor vehicle drivers who have been charged with MTO infractions. We can also assist you with cases involving very serious offences such as careless driving, operate motor vehicle no insurance, drive under suspension, fail to stop for a school bus, or fail to remain at the scene of a collision.

Being stopped and charged by the police, especially if you have been involved in a collision, will be a naturally stressful situation. Our experienced team understands the stress and anxiety that most defendants find themselves in, and will seek to ease the stress involved by resolving your matter at court on your behalf. For most cases, once our team has been retained you will never need to file a court document or set foot in a courthouse; you will never need to speak to a Prosecutor or Justice of the Peace, or respond to questions in a courtroom.

Once retained, our staff will respond to the court on your behalf to alert the court that we are contesting the charge(s) issued against you. Once a court date has been set, we will prepare and serve notice to the Prosecutor’s Office on your behalf for a release of evidence and then meet with the Prosecutor to review their evidence. Where a sufficient legal argument cannot be found to simply have your charge(s) withdrawn, most cases can at least have a negotiated settlement reached to reduce the number or nature of the charges, or reach an agreement to have the penalties reduced without the need for trial. However, should your case be one of the less common matters that results in a trial, having a licensed and experienced paralegal arguing on your behalf at court will provide you a much more effective defence than trying to represent yourself without an understanding of the court process and relevant case law.

We offer a no-cost, no-obligation review of matters and can provide you with a flat-rate cost on legal work to allow you to make an informed and educated decision on how to best protect your interests. Our staff can be reached via our toll-free number at 1-866-591-9206 or via email help@otdlegal.ca, online https://otdlegal.ca/contact/, or at any of our offices in person https://otdlegal.ca/contact/.
