The Penalties for Careless Driving

The penalties for careless driving in Ontario can include hefty fines, demerit points, and even license suspension. Fines can range from a couple of hundred dollars to several thousand dollars, depending on the severity of the incident. Drivers may also receive demerit points added to their license, which can affect insurance rates.

In more severe cases, if careless driving leads to property damage or injury, a driver’s license can be suspended. This suspension can range from days to years in some cases. 

Charges and Fines

Under the Highway Traffic Act, violators may face notable fines. The fine for a first offence can range from $400 to $2,000. Multiple offences may attract higher fines and other penalties. The exact amount can also depend on the circumstances surrounding the incident.

 

Demerit Points and License Suspension

Drivers convicted of careless driving will receive six demerit points on their driving record. Accumulating demerit points can eventually lead to license suspension. For a fully licensed driver, accumulating 15 points results in a 30-day suspension. Novice drivers face an immediate licence suspension upon conviction. 

 

Impact on Insurance Rates

Insurance premiums are likely to increase significantly after a careless driving conviction. Insurers view drivers with careless driving convictions as high risk. The exact increase can vary but often ranges from 50% to 100% or more. This can result in a financial burden, making it harder for drivers to afford their insurance.

 

Novice Drivers

Novice drivers who have a G1 or G2 license will receive stricter penalties for careless driving, including a mandatory license suspension. Insurance rates for novice drivers can skyrocket after such offences, making it much more expensive or completely unaffordable to drive.

If an accident caused by careless driving leads to bodily harm or death, novice drivers may face criminal charges. This can have long-term effects on their ability to get insured or even find employment in some fields. 

 

Commercial Drivers

Commercial drivers, especially those operating large motor vehicles, face even more significant consequences. Careless driving can result in the suspension or loss of their commercial driving license. This can impact their livelihood, as they depend on their ability to drive for work.

Insurance rates for commercial drivers can also increase dramatically. If careless driving results in bodily harm or death, the legal consequences can be severe, possibly leading to imprisonment. Additionally, companies employing commercial drivers can face CVOR points, fines and lawsuits.
