On April 1, 2022, the Ontario government added a new penalty for Stunt Driving/Race a Motor Vehicle. Anyone convicted of Stunt Driving under the Highway Traffic Act will now have to complete and pay for a mandatory driver improvement course within sixty days of the conviction or their license will be cancelled. The course must be completed through one of the governments approved driving schools. A list of all approved schools can be accessed by clicking here. The new penalty only applies to those both charged and convicted with Stunt Driving after April 1, 2022.
The new penalty accompanies several pre-existing penalties. If you have been charged with Stunt Driving/Race a Motor Vehicle under section 172 (1) of the Highway Traffic Act, you could face some or all of the following penalties:
• A court fine of not less than $2,000.00 and not more than $10,000.00 (plus a 25% victim fine surcharge).
• A license suspension of 1 to 3 years for a first offence.
• Jail term up to six months.
• Six demerit points.
• Five CVOR points for Commercial drivers.
• Substantial insurance increases.
Drivers will also face a mandatory thirty-day roadside driver’s license suspension, and a fourteen-day vehicle impoundment if pulled over for Stunt Driving/Racing.
